for apartment bookings
1. Operator details and contacts
This document governs the terms and conditions for booking and staying in the apartments of “Tenuta La Torraccia”, operated by Quattropiù s.r.l. società agricola, VAT No. 01615480561, with operating address Strada Provinciale 30 km 9, 01028 Orte (VT), Italy.

2. Definitions
- Property or Tenuta: Tenuta La Torraccia.
- Guest or Customer: the person making the booking, for themselves or on behalf of third parties, assuming full responsibility.
- Online booking: a booking made through the Property’s website and related booking and payment systems.
- Offline booking: a booking concluded via telephone, email, messaging apps, or contact forms, with subsequent written confirmation.
- Deposit: an amount paid as a confirmatory deposit (caparra confirmatoria) pursuant to art. 1385 of the Italian Civil Code.
3. Purpose and scope
These terms apply to all bookings of the Property’s apartments made online and offline. In the event of conflict between these terms and any specific conditions stated in a quote, booking confirmation, or a specific rate, the specific conditions shall prevail, provided they have been accepted in writing by the Guest.
4. Contract formation
Online booking: the contract is formed when (i) the Guest completes the booking process, (ii) expressly accepts these terms, and (iii) receives booking confirmation on a durable medium (email or equivalent).
Offline booking: the contract is formed when the Property sends written confirmation (email/WhatsApp or equivalent) and the Guest pays the Deposit within the deadline stated in the confirmation. If not, the Property may treat the request as lapsed without further obligations.
5. Availability, rates, taxes, and services
Rates, occupancy limits, and apartment features are those indicated on the website and/or in the booking confirmation. Unless otherwise stated, rates are per night and per booked unit. Any city tax, where applicable, and any extra services will be indicated before confirmation or at check-in, in accordance with applicable regulations.
The Property reserves the right to correct material errors or obvious mistakes in rates or availability, promptly informing the Guest and offering, at the Guest’s option, confirmation under the corrected terms or cancellation without penalties with a full refund of any amounts paid.
6. Payments, deposit, and balance
A confirmatory deposit is required to secure the booking. The amount, expressed as a percentage of the total stay, is indicated during booking or in the written confirmation.
The balance is due according to the method and deadlines indicated during booking or in the confirmation (for example, before arrival, at check-in, or as per the selected rate).
If the Deposit or the balance is not paid within the relevant deadline, the Property may terminate the contract, retaining the Deposit if already collected, without prejudice to any further damages.
7. No right of withdrawal
As these are accommodation services provided on a specific date or for a specific period, the statutory right of withdrawal applicable to distance contracts does not apply, pursuant to the exceptions set out in the Italian Consumer Code.
8. Cancellation policy and non-refundable deposit
8.1. The Deposit has the nature of a confirmatory deposit. Therefore, in the event of cancellation, withdrawal, or renunciation of the stay attributable to the Guest, the Deposit shall be retained by the Property and is non-refundable.
8.2. The above rule applies equally to online and offline bookings once written confirmation has been issued and the Deposit has been collected.
8.3. If the cancellation is attributable to the Property (non-performance not due to force majeure), the Property shall refund to the Guest an amount equal to the Deposit paid, unless the Guest prefers to agree alternative solutions (for example, rebooking).
8.4. Any stricter conditions linked to “non-refundable rates” or special offers shall remain applicable if expressly stated and accepted at the time of booking.
9. No-show, late arrival, and early departure
Failure to arrive by the agreed check-in time without notice constitutes a “no-show” and results in retention of the Deposit and, where provided by the accepted rate conditions, the charging of further amounts up to the full price of the stay, without prejudice to any further damages.
Late arrivals or early departures do not entitle the Guest to refunds, reductions, or credits, unless otherwise agreed in writing.
10. Booking changes
Requests to change dates, number of guests, or apartment are subject to availability and must be accepted in writing by the Property. Any rate differences (seasonality, minimum stay, promotions) shall apply to the new period and will be communicated before confirmation of the change.
11. Check-in, check-out, identification
All Guests must present valid identification documents at check-in in order to comply with applicable legal requirements. Check-in and check-out times are those stated on the website or in the booking confirmation; out-of-hours requests are subject to approval and may entail an extra charge.
12. Guests, maximum occupancy, and minors
It is not permitted to exceed the maximum occupancy stated for the booked apartment on the website and/or in the confirmation. The Customer is responsible for the conduct of any additional guests and any minors present.
13. House rules, prohibitions, and use of spaces
The Guest undertakes to use the accommodation with due care, complying with house rules and quiet hours. It is prohibited to organize parties or events in apartments or common areas without authorization. Separate terms may apply to events and weddings.
Smoking, pets, barbecues, swimming pool use, and other facilities are governed by any rules displayed on site and/or communicated before the stay; in the event of breach, the Property may terminate the contract for material breach, retain the Deposit, and charge damages.
14. Security deposit, damages, and charges
The Property may request a security deposit as a guarantee for damages, missing items, or violations. The amount and method will be communicated before check-in or at check-in.
The Customer is responsible for any damage caused to the accommodation, furniture, fixtures, and related areas, as well as reinstatement costs and extraordinary cleaning.
15. Force majeure
Neither party shall be liable for non-performance due to force majeure events (including, by way of example, natural disasters, governmental measures, or essential interruptions not attributable to either party). Where possible, the Property will propose reasonable alternative solutions (rebooking, voucher, alternative unit), subject to any mandatory rules.
16. Limitations of liability
Except in cases of wilful misconduct or gross negligence, the Property is not liable for loss, theft, or damage to personal belongings left in the accommodation or common areas, unless directly attributable to the Property.
The Guest acknowledges the rural nature of the Property and outdoor areas (paths, green areas) and undertakes to exercise due caution.
17. Privacy and communications
Personal data will be processed in accordance with the Privacy Policy made available on the website and referenced in contact and newsletter forms. Booking-related communications (confirmations, changes, operational information) will be sent to the contact details provided by the Guest.
18. Complaints and out-of-court resolution
Any complaints must be submitted in writing to info@tenutalatorraccia.it, stating the booking reference and a description of the issue.
19. Governing law and jurisdiction
This contract is governed by Italian law. For disputes involving consumers, the competent court is the court of the consumer’s place of residence or domicile, where applicable; in all other cases, exclusive jurisdiction shall lie with the Court of Viterbo, subject to any mandatory provisions.
20. Amendments
The Property may update these Terms and Conditions; the version applicable is the one accepted by the Guest at the time of booking.
